Marijanel.com is operated by Marijanel Knight, doing business as Marijanel Artistry. The legal business name is Marijanel Knight Photography.
Marijanel.com is an umbrella website representing Marijanel's creative work as an author, illustrator, artist, picture book creator, and mentor. The online store governed by these Terms may be accessed through Marijanel.com or through other websites or online platforms associated with Marijanel. Those websites or platforms may have their own terms, policies, and agreements.

By using this website or purchasing through our online store, you agree to these Terms & Conditions, together with any additional terms that may apply to a particular product, service, subscription, promotion, or purchase.

Nothing in these Terms limits any rights or remedies you may have under applicable consumer-protection legislation.

Original artwork and handmade products may contain natural variations, brush marks, texture, or other characteristics associated with their creation.

If an artwork is specifically identified as an Original, it is a one-of-a-kind original work.

Artwork identified as a Print, Limited-Edition Print, or similar designation is a reproduction of an original work, as described on the individual product listing.
The specific product information displayed at the time of purchase forms part of the information applicable to that purchase.

3. Intellectual Property

All original content appearing on Marijanel.com and associated Marijanel offerings is protected by copyright, trademark, and/or other applicable intellectual-property laws.

This may include, without limitation:
  • Artwork and illustrations
  • Watercolour paintings
  • Books and written work
  • Characters
  • Logos and brand elements
  • Names and trademarks
  • Photographs
  • Graphics
  • Website content
  • Videos
  • Educational materials
  • Digital products
  • Designs
  • Product imagery
  • Other original creative works

Unless otherwise stated, this content belongs to Marijanel Knight or is used with permission.

Purchasing a physical or digital product does not transfer copyright, trademark rights, reproduction rights, or other intellectual-property rights to the purchaser.
You may not copy, reproduce, republish, distribute, modify, sell, license, commercially exploit, or create derivative works from our content without express written permission, except where permitted by applicable law.

4. Artificial Intelligence and Machine Learning

Our original creative work is human-created and is protected by applicable intellectual-property rights.

You may not use artwork, illustrations, photographs, written work, books, characters, designs, digital products, educational materials, website content, or other original creative material from Marijanel.com for the purpose of:

  • Training, developing, fine-tuning, testing, or improving artificial-intelligence or machine-learning systems
  • Creating datasets for artificial-intelligence or machine-learning systems
  • Scraping or systematically collecting our creative work for artificial-intelligence or machine-learning purposes
  • Generating derivative works through artificial-intelligence systems

without express written permission from Marijanel, except to the extent that a particular use is permitted by applicable law.

Nothing in this section is intended to restrict rights that cannot legally be restricted.

5. Prices, Taxes and Payment

Prices are displayed with the applicable currency and may change from time to time.

Applicable taxes, shipping charges, and other charges will be presented during the purchase process as required by law.

Where additional costs cannot reasonably be determined in advance, such as certain customs duties, brokerage fees, or import charges, information about those potential costs will be provided as required by law.

Payment must be successfully completed through the payment methods offered at checkout.

We reserve the right to correct obvious errors in pricing, descriptions, or other information displayed on the website.

8. International Orders

Customers purchasing from outside Canada are responsible for providing accurate delivery information and complying with applicable laws and import requirements in their destination country.

Where applicable, customs duties, import taxes, brokerage fees, or other charges imposed by the destination country may be the responsibility of the customer.

We will provide information about applicable taxes, shipping charges, and other known costs as required by law.
International shipping availability may change as regulations, carrier requirements, customs rules, or other circumstances change.

9. Returns, Refunds and Damaged Products

Our general policy is that we do not voluntarily accept returns simply because a customer changes their mind, where such a policy is permitted by law.
Certain products, including personalized, customized, made-to-order, or digital products, may have specific return or refund conditions disclosed on the applicable product page or at checkout.

If a product arrives damaged or defective, please contact us as soon as reasonably possible. We may ask you to provide photographs of the product, packaging, shipping label, and damage so that we can assess the situation and, where appropriate, work with the shipping carrier or fulfillment provider.
For damaged physical products that can reasonably be replaced, we may provide a replacement, refund, credit, or another appropriate remedy.

An original one-of-a-kind artwork cannot be replaced with the same artwork if it is lost or damaged. Where an original artwork is genuinely lost in transit, we may offer store credit toward another purchase as a voluntary remedy, subject always to any rights or remedies required by applicable law.

Nothing in these Terms or our Returns & Refunds Policy limits any rights or remedies you may have under applicable consumer-protection legislation.

10. Lost or Missing Shipments

Unless specifically identified as a letter-mail or other untracked service, original artwork and other applicable physical products will generally be shipped using a service that provides tracking.

If tracking indicates that a shipment is genuinely lost, we will make reasonable efforts to assist with the shipment and, where appropriate, work with the carrier or fulfillment provider.

Because an original artwork is one-of-a-kind, a genuine loss of an original cannot be remedied by sending an identical replacement. We may offer store credit toward another purchase as a voluntary remedy, subject to applicable law.

For replaceable products, such as prints or books, we may replace the item where reasonably possible.

Where tracking confirms delivery to the address provided with the order, we generally do not replace or refund an item solely because the customer is subsequently unable to locate the package. We will consider the circumstances and any rights or remedies required by applicable law.

11. Digital Products and Content

Digital products and content may include digital prints, e-books, downloadable resources, files, educational materials, videos, audio recordings, classes, tutorials, or other digital offerings.

Digital products are generally non-refundable once access has been provided or a download has been made available, except where a refund or other remedy is required by applicable law.

Digital products and content are provided for the personal use described on the applicable product page or accompanying terms. Purchasing access to digital content does not transfer copyright or ownership of the underlying creative work.

Digital products and content may not be copied, redistributed, resold, shared, uploaded to publicly accessible websites, or commercially exploited without permission, except as permitted by applicable law.

Where a class, course, video, audio offering, or other educational product has specific terms, those terms may supplement these Terms & Conditions.

12. Subscriptions

Some products or offerings may be available on a recurring subscription basis.
Where a subscription is offered, the applicable subscription terms, price, renewal information, billing frequency, and cancellation information will be provided at the time of purchase.

Customers may manage or cancel eligible subscriptions using the subscription-management tools provided by the store.

13. Personalized and Custom Products

Personalized books, personalized artwork, custom artwork, commissioned work, made-to-order products, and other customized products may be subject to specific conditions stated on the individual product page or at checkout.
Because customized products are created specifically for an individual customer, they may not be eligible for a voluntary return or cancellation after production has begun, except where required by applicable law.

Customers are responsible for providing accurate information required to complete a personalized or custom order.

Marijanel.com may include links to Picture Book Creators and other websites, platforms, services, or offerings that are operated separately from this website.
These offerings may have their own terms, policies, privacy practices, purchase conditions, or agreements. Where a separate agreement applies, that agreement governs the applicable product or service.

Mentorship offered through Picture Book Creators is subject to a separate Mentorship Agreement.

Links are provided for convenience and do not necessarily constitute an endorsement. Marijanel is not responsible for the content, availability, policies, security, or practices of third-party websites or services.
